A restaurant owner wants the Texas Supreme Court to overturn a verdict that she defamed a customer by implying he is gay.Phong Van Meter filed a petition for review of the verdict last week, according to the Courthouse News Service.A Texas appeals court already has rejected Van Meter’s challenge to a Johnson County judge’s award of $5,000 in damages to restaurant customer Bennie Dale Morris.Morris had been a regular customer at Frank’s Place, dining there two or three times a day for 20 years, according to CNS.Morris said Van Meter subjected him to upsetting questions repeatedly in 2007 and 2008.When Morris was dining in the full restaurant, Van Meter allegedly said to Morris, loud enough for other patrons to hear, “Where is your wife?” or “Where is your husband?”In both questions, Morris said Van Meter was referring to Morris’ friend Glen Warren

Perhaps he was making an attempt (albeit it a poor one) at making small talk?
In court, Warren and Morris testified that they are not gay, and Morris said he repeatedly asked Van Meter to stop asking the questions but she refused, saying it would take a lawsuit to get her to stop.
